What should I do after a serious injury?
Get medical care, even if you feel okay at first, and follow through with treatment. Report what happened, keep your records and photographs, and be careful about giving recorded statements to an insurer before you have talked to a lawyer. Early decisions can affect your claim.
The insurance company already offered me a settlement. Should I accept it?
Be cautious. Early offers are often made before the full extent of your injuries is known, and once you settle you usually cannot reopen the claim. It is worth an honest second look before you sign anything.
What if I was partly at fault?
Alabama’s contributory negligence rule can bar recovery if you are found even partly to blame, and insurers lean on it hard. That is exactly why the investigation matters so much. Do not assume you have no case before talking to a lawyer.
What if the other driver had no insurance, or too little?
You may be able to recover through your own uninsured/underinsured motorist (UM/UIM) coverage. These claims have their own rules and deadlines, so it helps to review your policy with someone early.
How long do I have to file in Alabama?
In most Alabama personal injury cases, two years from the date of injury (Ala. Code § 6-2-38), though some situations have different requirements. Evidence also fades quickly, so it is best to ask early rather than wait.
